Obtain Justice and Accountability for Childhood Sexual and Physical Abuse

!±8± Obtain Justice and Accountability for Childhood Sexual and Physical Abuse

It is a known fact, civil suits are more easily won than criminal suits, therefore, an increasing number of childhood sexual abuse survivors (CSAS) are launching civil suits as a means to obtain justice and accountability for their abuse.

Adult Child Sexual and Physical Abuse survivors are bringing actions seeking accountability as well as damages for the cost of past and future therapy, loss of childhood, failure to fulfill potential and the long-term emotional damage resulting from the abuse. Claims can be lodged for sexual abuse, assault and battery, unlawful restraint, invasion of privacy, and intentional or negligent infliction of emotional distress.

The majority of the states have a provision extending the statute of limitations for adult survivors of CSAS, although the remedy varies depending upon state. See http://www.smith-lawfirm.com/statutestable.html for your states statute.

Because it is very difficult to generalize the law in all 50 states, survivors are urged to seek the advice of an attorney in their state.

Monday, March 15, 2006, the progressive state of Idaho recently gave people a lifetime to seek justice for sexual child abuse. Idaho governor Dirk Kempthorne signed a bill into law that will give people a lifetime to seek justice for sexual child abuse. The legislation, co-sponsored by Rep. Debbie Field (R-Boise) and Rep. Donna Boe (D-Pocatello), eliminates the state's statute of limitations, which required victims to report the crime by their 23rd birthday in order for prosecutors to file charges. "If you have ever done this to a child, you are going to remain accountable," said Field. "What an honor it is to provide victims a chance to be heard." Paul Steed, an Idaho citizen who fought for the law, celebrated and reflected on how good it feels to fight for child protection and win, something often pointed out by PROTECT members. "This has been very, very therapeutic."

In some cases, adult survivors can launch claims against property owners for failure to provide adequate security. For example, successful suits have been brought against parking lot and garage owners, hotel/motels, school districts, private owners of buildings open to the public and apartment building owners.

While the majority of abuse civil suits are brought by sexual abuse survivors many physical abuse survivors are recognizing their right to seek accountability and justice.

Rocky Mountain Ski Resorts to Experience

!±8± Rocky Mountain Ski Resorts to Experience

There are dozens of ski resorts throughout the Rocky Mountains. Many of them are small such as Beaver Mountain Ski Resort just a few miles from my home. But, there are others that warrant at least one visit in a lifetime. Some of these resorts may offer star gazing, while others showcase the magnificent beauty of the Rocky Mountains. Whichever the case, here are my picks for the top resorts. (These are not listed in any particular order.)

Park City Mountain Resort: Park City, Utah

One of the sleepy town ski resorts that transformed to a mega resort in my lifetime. Growing up, the mountain wasn't crowded and it wasn't overly expensive. There was a mountain top lodge with views that never stopped and runs with moguls that would swallow the timid. Later on, Jupiter Bowl was opened (when weather permitted) and had some runs that would begin an adrenalin rush that would last for the next week. After all of these years, it is still one of my favorite resorts for the variety. From some of the most difficult to pleasant runs for the beginner, Park City Mountain Resort offers skiing for all abilities.

Other reasons that you may want to visit Park City Mountain Resort is for the Sundance Film Festival held every January. If you go during this time, be prepared for crowded restaurants, crowded runs and non-existent hotel rooms. The star gazing may be a premium during this time, but so are the people. After the crowd has left, take a stroll down Main Street for some great restaurants, gift shops and an architectural glimpse of the old mining towns of the west.

Sun Valley Ski Resort, Ketchum, Idaho

In the middle of nowhere and that is why people love it. The rich and famous fly into the Hailey, Idaho airport on their private jets (and they are lined up), or people like me can drive in from Boise, Idaho (3 hours), or Salt Lake City, Utah (about 5 hours). There are regional flights from both Boise and Salt Lake City if you would rather fly into Hailey.

Sun Valley has a rich history of the resort life. It did begin as a sleepy resort town with a luxurious hotel, huge log lodges at the base of the mountain and on the summit. Once you enter one of these lodges, it is almost impossible to want to return outside to the cold. With small hotels, large condominium developments and cabins that rival the ski lodges, there is something for everyone. In the evenings, there are hundreds of restaurants, movie theaters and bars to keep people busy. The town fathers have managed to keep a feeling of openness with most of the area. But there is no mistaking that there is a ton of development hidden behind those pines.

Vail, Colorado

Can you picture a camera focused on a single skier in the middle of a mogul run with nothing but white surrounding them? Now, the camera begins to zoom out with the picture getting wider and wider. Another second and the skier is just a spec on a field of white. With this picture in mind, you may begin to feel the immensity of some of the bowls of Vail. This is a place that I only dreamt of and now I dream of returning.

With a narrow valley that includes an interstate (I-70) and the town of Vail, everything is at the base of the mountain. The resort area seems to go on forever with the feel of small villages every so often. Hidden in these villages are restaurants, hotels, condominiums, ski schools, rental offices and the essence of Vail.

Back to the picture of the lone skier in the middle of the mogul field. Sitting at the top of the mountain, the sun was shining on me and my two friends with me. There wasn't just one of these vast fields of moguls, but three. Each was as large as the next. It was pure heaven for a mogul nut. However, beyond was something that everyone should experience at least once ... the view across the top of the Rocky Mountains. The heavens touch to the tops of the mountains and you realize the majesty of the mountains.

Tips for a Better Hotel Stay

!±8± Tips for a Better Hotel Stay

Every day I encounter people either coming from or going to the airport. Some are experienced travelers; some are terrified at the 'big' airport they have landed at. All have one of two goals in mind - get to the hotel as quickly as possible or get to the plane as easily as possible. Here are just a few thoughts to help you achieve your goal.

1). ALWAYS keep a print-out of your reservation handy. At most airports in the U.S. there are multiple franchises, sometimes distinguished by innocuous words like Days Inn West or Comfort Inn South. Knowing the address of where you are going helps to get the right shuttles, directions for cabs and even the hotel you are attempting to get to.

2). If you do not have a room reservation and are calling hotels from the airport 'hotel' board, do not call five hotels and have them send out a shuttle when you know you won't be staying with them. This often results in shuttles dead-heading home without a passenger and makes their real guests wait longer for the next shuttle. You may someday be on the receiving end of this because some yahoo called for your shuttle 15 minutes before you and now it has already left the airport.

3). Do your homework when booking a hotel if you require certain features like restaurants or grocery/drugstores nearby (and open late if necessary), a fitness center, continental breakfast, business center, public transportation, etc. This you can sometimes discover by reading reviews. Reviews may also tell you if the area is safe enough to walk in after dark

4). Do a walk through of your room when you depart. This will uncover those shampoos left in the shower, medicines in a drawer, shoes or DVD's or flash drives left under a bed and clothes hanging behind the bathroom door. ALWAYS check electrical outlets for phone, camera or battery chargers left plugged in.

5). Do not assume you can miss your scheduled shuttle BACK to the airport and just 'catch the next one' or get an earlier one. Most are on reservation status and may not have room on the next one, meaning you either have to take a cab or perhaps wait an hour or more for a ride.

These are just a few common sense suggestions but are often forgotten about in the hustle and bustle of making reservations, negotiating airport layovers and transfers from airport to hotel and back. They can save you aggravation, time, money and even potential lost business when you discover you forgot your business notes, phone charger or PDA in the hotel room.

The official agencies are receptive to the people's concerns and lend wholehearted support to redress their grievances.
